This list is not exhaustive, so if you have suffered an injury contact us to find out whether you might be able to bring a claim.

Under the Consumer Protection Act 1987, all products – whether physical or digital - must meet the following standards:-

  • Be of a satisfactory quality. They should not be faulty or damaged when you receive them
  • Be fit for the purpose they are supplied for, as well as any specific purpose you made known to the retailer before you agreed to buy the goods
  • Match any description given to you, or any models or samples shown to you at the time of purchase

Where a product falls short of these requirements and you are injured as a result, you may be able to bring a claim for compensation.

In accordance with the Consumer Protection Act 1987, anyone who is injured or suffers illness as a result of a faulty product can seek to claim compensation from the manufacturer.

In order for your claim for compensation to be successful, it must be established that:

  • The product was defective and
  • That the defect caused you injury

You do not need to establish negligence against the Defender. However, you will be required to prove the product was faulty and your injury was caused by the defect.   The team at Calio Claims have considerable experience in handling personal injury claims involving faulty or defective products and can manage all aspects of your case for you.

In order to bring a successful claim, it is important that you keep the product,  its packaging,  the original purchase receipt and any other paperwork such as the instructions, the guarantee and a user manual.  Taking photographs of the item and your injury is also very helpful.

A product can be almost anything that can be packaged and sold and can include any electrical good including its component parts. Where a component of a product or any raw material incorporated into a finished product is defective, it is possible that both the manufacturer of the component and the manufacturer of the finished product will be liable.

Responsibility for product safety falls upon the producers. This may be:

  • A person or company who have put their name on the product, or have used a distinctive trade mark and is confirmed as the producer of the product
  • A person or company who has imported the product either within the European Union or outside the Union for it to be sold on

Our specialist solicitors can assist you in obtaining compensation for injury, as well as helping with rehabilitation and aftercare, recovering the cost of care, and pursuing any loss of earnings. We can also recover the cost of any damage to your property caused by the defective product.
