Circumstances of accident
We acted on behalf of a firefighter who was deployed by his employer to rescue a horse which had become stuck in a muddy field. Our client was in attendance for almost 3 hours and was instructed to support the horse whilst a vet administered a sedation drug. During the rescue, our client’s legs became stuck in the muddy field. He required to lift large slab-type boulders from the area to free the horse. This resulted in an injury to his knee.
We argued that our client’s employer failed to implement appropriate health & safety protocols during the task that he was instructed to do, and, that this resulted in a failure to adequately reduce the risk of injury.
Our client’s employer accepted that they were at fault for his injuries but failed to make any appropriate offers. We therefore raised a Court action on our client’s behalf.
How we helped our client
In addition to seeking damages for our client’s injury, we sought compensation for physiotherapy which he required to assist with resolution of his symptoms. Our client was unable to work for a number of months due to his injury and we sought damages for his lost earnings. We also sought compensation for assistance that he required from his wife with day to day living tasks.
We obtained an expert medical report which dealt with the injury sustained, the recommended treatment, the anticipated prognosis and supported the fact that he needed time off work to recover.
Settlement
We were able to obtain a settlement of over £6,000 for all of our client’s heads of claim. He was delighted with the outcome.
