Those who have been involved in a road traffic accident can be hesitant to claim as they are unaware of what they may involve. Here at Calio Claims, we can guide you through the process from initial discussion to settlement in whatever form that may be.

How do I make a claim?

Firstly, you should contact our team to discuss your accident. Once we have obtained the necessary details, a claim will be intimated to the offending party.

The offending party have a timeframe of three to four months to respond confirming whether they are willing to enter settlement negotiations.

What if the offending party don’t respond?

If we are in the situation where no response is forthcoming, we would be seeking to raise a court action in pursuit of your claim. Initially, this is an administrative task where we would open a line of communication with the Defending solicitors to reach settlement.

A provisional final hearing date is set early on in a court action. Most cases settle prior to the final hearing, however, should settlement not be agreed, you would be required to attend court and give evidence.

What if they don’t respond to the Court Action?

In the situation where no response is forthcoming despite a court action being raised, we would ask the court to grant Decree against the offending party. Essentially, this is an order from the court for the offending party to make payment as they have failed to enter the process of the Court Action.

The Decree would then be served upon the offending party who have the option to make payment of the Decree in full or enter the Court Action and defend the action.

What happens if they don’t respond to the Decree?

It is a rare situation where an offending party will not respond to a Decree. However, should your claim be in this position we would arrange to serve a charge for Bank Arrestment on the opposing party’s bank.

When a Bank Arrestment charge is served, the funds detailed in the Decree are held. At which point, the offending party will be notified of the Bank Arrestment. Thereafter, it is generally the situation that payment will be made, and your claim would be concluded.
