After years of allegations and complaints from patients, a Public Inquiry, commissioned by the Scottish Government, into the actions of the disgraced Surgeon, Dr. Eljamel and the role of NHS Tayside is now underway.

This Inquiry will provide a platform to examine the full extent of the harm caused to Dr Eljamel’s patients and the systemic failures that appear to have allowed it to continue.

On Friday 13th September, the Inquiry published its Draft Terms of Reference.

The scope of the Public Inquiry

The Public Inquiry is tasked with investigating several key areas relating to Dr. Eljamel's time at NHS Tayside. These areas include:

  1. Establishing the Full Extent of Harm: The Inquiry will examine the number of patients affected by Dr. Eljamel's treatment and the nature of the injuries they suffered. This will include consideration of the surgeries performed, misdiagnoses, and long-term physical or psychological trauma inflicted upon patients.
  2. Assessing NHS Tayside's Oversight: It will also consider how NHS Tayside managed or failed to manage concerns about Dr. Eljamel. The Inquiry will scrutinize the systems in place at the time, including clinical governance, complaints procedures, and internal reporting systems, to understand how they may have contributed to the prolonged harm caused by Dr. Eljamel.
  3. Ensuring Accountability: The Inquiry will seek to hold both Dr. Eljamel and any relevant authorities accountable for their roles for any failures which are established. 
  4. Providing Justice for Victims: At its core, the Inquiry is an opportunity for victims to have their experiences heard and recognised.
