Circumstances of accident
Our client was travelling in the Highlands as a passenger in her partner’s vehicle. Her partner began an overtake manoeuvre on a slow moving vehicle in front. As they drew level with the slow vehicle, this in turn pulled out to overtake a cyclist in front of them. The vehicle collided with the passengers which then caused them to roll off the road and into a ditch.
We intimated the claim and the insurer initially denied liability.

Through careful investigation which included speaking with police officers and witnesses who attended the scene, we are able to establish that the third-party vehicle was indeed at fault. Despite these investigations, the insurer continued to deny liability.
We were then required to raise a court action in Edinburgh.
Settlement
