We acted on behalf of an injured party in respect of a road traffic accident. The claim was intimated to the third-party insurer who denied liability. The circumstances and factual matrix of the claim indicated that liability ought not to have been an issue, so we were quick to raise court proceedings.
The third-party insurer then instructed solicitors to defend the case on their behalf. After realising their initial mistake, the third-party insurer via their instructed solicitor was quick to admit liability.
Usually, when claims have an admission of liability under court proceedings, it’s a simple matter in terms of valuing the claim and securing a timely settlement. Unfortunately, the insurance company’s conduct throughout the court proceedings remained below par. They intimated a low offer which was far outwith the steer of what the court would award.
On that basis, we informed the insurance company that we were content to proceed to a final court hearing to settle the case.
Despite having a final pre-trial meeting with the insurer, the purpose of the meeting being to discuss settlement of the case without having to go to court, they maintained their low offer.
Through careful drafting of written submissions, we were able to thoroughly prepare our client’s case for the court hearing. We then acted for the client in the court hearing and were able to secure a 50% increase from what was originally offered. This represented a fair and reasonable value for our client’s injuries and losses. It’s important to stress that not all road traffic claims will make it to a final court hearing, the vast majority do tend to settle outwith court albeit in a litigation process.
The five-figure settlement our client received represented an end to a long litigation process.
