Circumstances of accident
Our client was involved in an accident that was not her fault. A third-party vehicle drove into the rear end of her vehicle. She suffered from injuries to her neck, right shoulder, and experienced travel anxiety. Her vehicle was damaged and had to be collected, recovered, and stored. Pre-litigation our client was offered £1,925.

We instructed an independent Orthopaedic specialist to examine her injuries and raised the claim as a court action in the specialist, All-Scotland Sheriff Personal Injury Court.
We knew that the offer of £1,925 was unreasonable and proceeding with a court action would benefit our client.
A further offer was lodged by the insurance companies’ solicitors with the court in the sum of £4,000. Based on the evidence we had gathered, we rejected this offer and made our own counter offer, in the form of a Pursuer’s Offer, totalling £11,000.
Settlement
Ultimately, the claim was resolved without the need of a final court hearing, for the sum of £11,000. A 471% increase on the pre-litigation offer.
