Circumstances of claim
Our client was stationary at a set of traffic lights. Suddenly, the car behind our client failed to stop and hit the back of their car.

We instructed a medical report from a General Practitioner to comment on our clients’ injuries and prognosis.
A claim was intimated to the Insurers for the Third-Party driver. No response was received, and a court action was subsequently raised.
Issues with the claim
The Third-Party Insurers failed to respond to the Court Action in the allocated timeframe. We therefore applied to the court for Decree in absence. The Decree was granted and served upon the Third-Party Insurers.
The Third-Party Insurers failed to respond to the Decree.
Due to the lack of response, we served a charge for Bank Arrestment on the Third-Party Insurers bank where the funds were held in lieu of payment.
Settlement
Our client was diagnosed as suffering from whiplash injuries to their neck and back.
Our client’s car was damaged and they required the use of a hire vehicle while their own car was being repaired.
Fortunately, the Bank Arrestment prompted a response from the Third-Party Insurers and settlement was agreed at £9,450.
