Circumstances of Claim
Our client was driving his motor vehicle when suddenly and without warning, the vehicle travelling in front of him started to reverse backwards. He sounded his horn to warn the other driver to stop, but she proceeded to collide with his vehicle.
As a result of the accident, our client suffered a whiplash injury to his back and shoulder, resolving within 12 months of the accident, with the assistance of physiotherapy treatment. He also suffered tinnitus in his right ear, which was expected to resolve within 18 months of the accident date.
How we helped our client
We obtained medical reports from an expert GP, orthopaedic surgeon and ENT surgeon to support our client’s case. We also obtained evidence of the costs of his physiotherapy treatment and confirmation of his loss of earnings as he was absent from work following the accident. This allowed us to accurately value his claim and thereafter negotiate with the Defender’s agents to obtain the best possible settlement for our client.
Settlement
Following our medical reports, the initial offer of settlement from the Defender in this case was £10,000. After negotiations with the Defender, we managed to achieve damages for our client in the sum of £14,000. This provided appropriate compensation for both our client’s injuries, as well as covering his loss of earnings and his treatment costs.
