Circumstances of accident
Our client attended the A&E Department at their local hospital after they had sustained a deep cut to their hand.
While being examined, the treating nurse removed the compress, and our client began to lose a lot of blood. As a result of this, our client fainted and hit their face off the nearby blood pressure machine sustaining further injury.
How we helped our client
Our client sustained soft tissue injuries to the left-hand side of their face and to their temporomandibular joint.
At the time of the assessment, one month post injury, our client continued to experience pain and discomfort over the left muscle of mastication.
We obtained a specialist report from a Maxillofacial Surgeon who confirmed that our client suffered severe pain and discomfort for a period of 9 months, and an associated exacerbation of their pre-existing degenerative jaw changes.
Any symptoms post 9-months would be linked to the degenerative changes rather than the accident itself. We then intimated the claim to the NHS.
Settlement
Our client’s claim was subsequently settled for £2,500 by way of negotiation with the NHS. This was over a 40% increase from the initial offer made at the outset of the claim.
Accordingly, we were able to obtain a settlement that our client was happy with, settle their claim swiftly and without the need for litigation.
