Circumstances of accident

We acted on behalf of a client who suffered the loss of his left testicle due to a misdiagnosis by an A&E department.

Our client began experiencing testicular pain and immediately attended A&E for treatment. He was examined and was informed by the treating doctor that his testicle appeared normal and that he was simply suffering from an infection. Two days later, our client visited his GP complaining of worsening pain, and he was referred to the hospital. Unfortunately, our client had suffered a testicular torsion and by the time he attended hospital on the second occasion, it had to be removed.

How we helped our client

We ingathered our client’s medical records and obtained an expert report from an A&E expert who concluded that our client’s treating doctors had breached their duties of care by failing to correctly diagnose the testicular torsion.

We then obtained a causation report from an expert urologist, who concluded that there was up to an 80% chance our client’s testicle could have been salvaged had the hospital acted immediately following our client’s first attendance.

After carrying out the necessary investigations, we intimated a claim on the health board.

Settlement

The initial offer of settlement was £15,000, and we were able to achieve over double this for our client in the sum of £33,000. This provided appropriate compensation for our client’s pain and suffering.
