Circumstances of Claim
Our client was having a tooth extracted when her dentist lost control of the drill and injured her cheek. She required stitches for the wound. It took around 4 weeks for the injury to her cheek to heal.
Following the incident, our client developed a fear of the dentist, including anxiety, flashbacks about what had happened and sleep disturbance.
How we helped our client
We obtained medical reports from an expert psychologist, who diagnosed our client with a specific phobia of the dentist, called Dentophobia. The expert recommended that our client undergo CBT or EMDR treatment to assist with overcoming her phobia of the dentist. This allowed us to accurately value her claim and thereafter negotiate with the Defender’s agents to obtain the best possible settlement for our client.
Settlement
The initial offer of settlement from the Defender in this case was £700. Following our medical evidence and negotiations with the Defender, we managed to achieve damages for our client in the sum of £2,750. This provided appropriate compensation for both our client’s injuries, as well as her recommended treatment costs.
